These Terms & Conditions (“Terms”) govern your access to and use of the mobile application “ConnectMe App” (“App”), operated by ConnectMe App B.V., registered in the Netherlands (hereinafter “we”, “us”, “our”). By downloading, installing or using the App, you (“you”, “User”) agree to be bound by these Terms.
1. Definitions
1.1 “Account” means your registered user profile on the App.
1.2 “User Content” means any content, materials, messages, check-ins, profiles, images, or data that you create, upload or share via the App.
1.3 “Services” means the features and functionality provided by the App, including check-ins, map display, chat, University Mode, Sports Mode, subscription/Pro features, and any other service features we may add.
1.4 “Subscription” means paid access to certain additional features (“Pro Features”) of the App.
1.5 “Location Data” means the real-world location information (including your device’s location) that you provide or that is collected when you use the App.
2. Acceptance and Changes
2.1 By creating an Account or otherwise using the App, you accept and agree to these Terms and our Privacy Policy.
2.2 We may revise these Terms from time to time. We will notify you of changes (for example via the App or by email). Your continued use of the App after notification means you accept the revised Terms. If you disagree with the changes, you must stop using the App and close your Account.
3. Licence to Use the App
3.1 Subject to your compliance with these Terms, we grant you a non‐exclusive, non‐transferable, revocable licence to install and use the App on your compatible mobile device for personal, non-commercial use.
3.2 We reserve all rights not expressly granted to you.
4. Registration and Account Security
4.1 You may register via Apple, Google, Facebook or Instagram login, or by other means if provided. You must provide accurate, up-to-date information.
4.2 You are responsible for keeping your password secure and for all activity under your Account. You must notify us immediately of any unauthorised use of your Account.
4.3 You may not share your Account or let others access it except as permitted by us.
4.4 We may suspend or terminate your Account if you breach these Terms or if we suspect misuse.
5. Acceptable Use & User Obligations
5.1 You agree to use the Services in accordance with all applicable laws and regulations (including data protection laws such as the General Data Protection Regulation (“GDPR”)).
5.2 When using the App you agree not to:
(a) post or transmit User Content which is unlawful, defamatory, obscene, harassing, threatening, infringing intellectual property rights, or otherwise objectionable;
(b) impersonate any person or entity or misrepresent your affiliation;
(c) attempt to gain unauthorised access to the App’s systems or another user’s Account;
(d) use the App for commercial solicitation or spam other users;
(e) collect or store personal data about other users or share such data without their consent;
(f) misuse the Location Data of other users or attempt to track or stalk other persons.
5.3 In relation to the App’s check-in, map and location functions you agree that:
(a) you will not falsify your check-in location or time;
(b) you will respect other users’ privacy and will not attempt to identify or locate others outside of the intended App functionalities;
(c) you will use the University Mode and Sports Mode only for their intended purposes (study buddies, workout partners) and will not misuse or misrepresent your status.
6. User Content
6.1 You retain all ownership rights in your User Content, but you grant us a worldwide, royalty-free, non‐exclusive licence to store, host, reproduce, modify, publish, translate, distribute and display such content for the purposes of providing the App and Services.
6.2 You represent and warrant that you have all necessary rights to your User Content and that submission does not violate any laws or rights of third parties.
6.3 We do not guarantee any privacy or confidentiality for User Content you share or post; you are responsible for what you post.
6.4 We reserve the right (but are not obliged) to remove or disable access to any User Content that violates these Terms or is deemed inappropriate in our discretion.
7. Paid Subscriptions / Pro Features
7.1 The App may offer certain paid “Pro Features”. Subscription fees, billing cycles and payment terms will be clearly displayed to you at the time of purchase.
7.2 You authorise us (or our payment provider) to charge the applicable fees to your chosen payment method.
7.3 Unless otherwise stated, subscriptions automatically renew at the end of each billing period and you must cancel prior to renewal if you wish to stop.
7.4 Refunds are subject to our refund policy (which may be limited). We will inform you how refunds are handled.
7.5 Free or standard features (e.g., check-in at schools/universities or sports locations) remain free unless otherwise informed.
8. Privacy and Location Data
8.1 We collect and process your personal data (including Location Data) in accordance with our Privacy Policy.
8.2 You may manage your privacy and location-sharing settings via the App (for example toggling background location sharing, setting refresh intervals, disabling read receipts or last seen status).
8.3 You acknowledge that the App’s core functionality (map, check-in, chat) relies on location information, and without granting required permissions the functionality may not work or may be limited.
8.4 You must ensure you have the right to share any location information and that no-one else’s rights are infringed when you share or post location data.
9. Intellectual Property
9.1 All intellectual property rights in the App, Services, branding, graphics, software, databases and documentation are owned by us or our licensors.
9.2 You shall not copy, modify, distribute, reverse engineer, decompile or create derivative works of the App (except as permitted by applicable law).
9.3 All trademarks, service marks, trade names, logos appearing in the App are our property or the property of third parties.
10. Disclaimers, Limitation of Liability & Indemnity
10.1 The App and Services are provided “as is” and “as available” without any warranties of any kind, whether express or implied (including merchantability, fitness for a particular purpose, non-infringement).
10.2 We do not guarantee that the App will be uninterrupted, error-free, secure, or completely free of viruses or other harmful components.
10.3 To the maximum extent permitted by law, our total liability for any and all claims arising out of or relating to these Terms or the App shall be limited to the greater of (a) the amount you have paid us in the preceding 12 months, or (b) EUR 50.
10.4 We shall not be liable for any indirect, incidental, special or consequential losses (including lost profits, data loss, business interruption) arising out of or in connection with your use of or inability to use the App.
10.5 You agree to indemnify, defend and hold us (and our officers, employees, contractors) harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or violation of any law or rights of a third party.
11. Termination & Suspension
11.1 We may suspend or terminate your Account and access to the App at any time, with or without notice, if we believe you have violated these Terms or pose a risk to other users or the App.
11.2 On termination your rights to use the App will cease immediately. We may delete or deactivate your Account and User Content.
11.3 You may close (“delete”) your Account at any time using the functionality in the App (Settings → Remove Profile / Logout).
11.4 Even after termination or deletion of your Account, clauses which by their nature survive (such as Intellectual Property, Limitation of Liability, Indemnity, Governing Law) shall remain in force.
12. Governing Law & Jurisdiction
12.1 These Terms shall be governed by and construed in accordance with the laws of the Netherlands.
12.2 Any dispute arising out of or in connection with these Terms shall be submitted to the competent court in [city], Netherlands (or any alternative dispute resolution mechanism we may specify).
13. Changes to the Service
13.1 We may modify, suspend or discontinue any part of the App or Services (including paid features) at any time, temporarily or permanently, without notice or liability to you.
13.2 We will endeavour to provide reasonable notice of major changes, but unless stated otherwise you acknowledge that the App is evolving and features may change.
14. Miscellaneous
14.1 If any provision of these Terms is held invalid or unenforceable, that provision shall be struck out and the remainder of the Terms shall continue in full force.
14.2 These Terms, together with our Privacy Policy and any other terms expressly referenced, constitute the entire agreement between you and us relating to your use of the App, and supersede any prior agreements.
14.3 You may not assign or transfer your rights or obligations under these Terms without our prior written consent, but we may assign our rights or obligations to a third party.
14.4 The failure by us to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
